Welcome to TravelMechanic! These Terms of Use, together with our limited warranty accessible at [Limited Warranty], our privacy policy available at [Privacy Policy], and all other rules, policies, terms, and conditions mentioned or linked herein, collectively constitute the "Agreement." This Agreement establishes a legal understanding between you ("you") and TravelMechanic, also referred to as "we" or "us."

By accessing or using our applications, websites, content, products, programs, and services (collectively, the "Services"), you agree to be bound by this Agreement. Please read these Terms carefully before accessing or using our Services. If you disagree with any of the Terms, you may not access or use the Services. These Terms, along with any Supplemental Terms (defined below), supersede any prior agreements or arrangements and take precedence over any content or information available elsewhere, such as on our website, in emails, or within our applications. TravelMechanic reserves the right to terminate this Agreement or any Service concerning you, or to discontinue offering or deny access to the Services or any part of them, at any time, for any reason or without reason

Supplemental terms

Supplemental terms are additional conditions or policies specific to particular Services, including our Privacy Policy. These terms may encompass conditions for specific events, activities, programs, or promotions. Supplemental Terms are an extension of this Agreement and will take precedence over these Terms if a conflict arises regarding the relevant Service(s)

Amendments

TravelMechanic may revise these Terms occasionally. Any revisions become effective when posted on our platform or when updated Supplemental Terms are published. Your continued access or use of the Services after such changes will signify your consent to be bound by the amended Terms

Your representation

By accessing and using our Services, you represent and warrant that:

  • You are at least 18 years old and a legal adult in your jurisdiction
  • You have the right, authority, and capacity to enter into this Agreement and adhere to the Terms
  • If entering into this Agreement on behalf of a company or organization, you have the authority to act on their behalf and bind them to this Agreement
  • The Services are not available to individuals under 18 or whose accounts have been terminated. Your account may not be used for Services performed for another person

The services

Welcome to TravelMechanic, where we provide a cutting-edge technology platform encompassing websites and mobile applications (referred to as the "TravelMechanic Platform"). Our platform empowers users like you to seamlessly connect with a network of skilled vehicle service providers, including mechanics, technicians, inspectors, and other independent contractors (collectively referred to as "Technicians"). Additionally, you can easily arrange a wide range of vehicle-related services, such as inspection, diagnosis, maintenance, repair, towing, and more (referred to as "Vehicle Services")

License

By using our platform, you are granted a limited, non-exclusive, non-sublicensable, revocable, non-transferable license, subject to your compliance with our Terms and Conditions. Please read and understand these terms carefully. This license allows you to access and use our Services in accordance with the terms set forth in this agreement. Please note that any rights not expressly granted here are reserved by us

Restrictions

To ensure fair and responsible use of our platform, we impose certain restrictions:

  • Preservation of notices: Do not remove any copyright, trademark, or other proprietary notices from any part of our Services
  • Usage limitations: You may not reproduce, modify, create derivative works, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast, or otherwise exploit our Services unless expressly permitted by us
  • Reverse engineering: Do not attempt to decompile, reverse engineer, or disassemble our Services, except as may be permitted by applicable law
  • Linking and framing: You may not link to, mirror, or frame any portion of our Services without our prior consent
  • Data mining: Avoid any activities aimed at scraping, indexing, surveying, or data mining any part of our Services, which could unduly burden or hinder the operation and functionality of our platform
  • Unauthorized access: Do not attempt to gain unauthorized access to or impair any aspect of our Services or its related systems or networks

Your use of our services

At TravelMechanic, we want to ensure that your experience using our services is seamless and efficient. To make the most of our offerings, please review the following guidelines:

User accounts

To access and utilize most aspects of our services, you'll need to register for and maintain a user account, known as your "Account." During the registration process, we will request certain personal information, including your name, email address, physical address, vehicle information, and mobile phone number. Additionally, you may need to provide at least one valid payment method, such as a credit card

We emphasize the importance of providing accurate, complete, and up-to-date information within your Account. Maintaining the accuracy of your account details is essential. Failure to do so may result in limited access to our services or termination of your agreement with TravelMechanic. Please be aware that you are responsible for all activities conducted under your Account, and it's crucial to safeguard your Account username and password. We cannot be held liable for any losses incurred due to the unauthorized use of your password. If you suspect unauthorized access to your Account or a security breach, please inform us immediately

Scheduling a service

When you're ready to request a service, referred to as a "Job," you may need to provide specific details:

  • Service type: Specify the type of service you believe is required
  • Location: Indicate where you'd like the service to be performed
  • Date and time: Choose a suitable date and time for the service

It's your responsibility to ensure that the location you choose for the service is suitable and accessible to our technicians. Ensure that the technician has the necessary access, permissions, and legal authorization to complete the job at your chosen location

Once you submit a Job Request, we may provide you with pricing information and a list of available technicians. This may include their experience and customer ratings, where applicable. Please note that we reserve the right to modify, add, or delete items and prices at any time before billing you

If you agree with a technician to make changes to the Job Request or reschedule the job, these changes should be documented within the TravelMechanic platform, either by you or the technician. Be aware that rescheduling may incur additional fees

Cooperation and courtesy

We expect all users to treat our technicians courteously and lawfully. It's essential to provide a safe working environment that complies with all relevant laws and regulations. Cooperate reasonably with technicians to facilitate the completion of the job. Please be aware that the availability of independent technicians on our platform may vary due to factors like illness or vacations

Providing parts

You have the option to supply parts for a technician to install as part of a job. If you choose to provide some or all of the parts, please note that this action voids the Limited Warranty offered by TravelMechanic for those parts. Additionally, any additional labor hours required to secure correct parts due to inaccuracies in customer-supplied parts will impact the job estimate. In such cases, a job invoice will be updated to include associated labor and material costs, totaling no less than twenty-five percent of the total labor. TravelMechanic is not liable for incorrect customer-supplied parts

Component fragility

Certain engine and cooling system components, especially those made of plastic, composite, or rubber, can become fragile over time due to age and temperature fluctuations. During procedures involving disassembly or handling of such components, they may break or disintegrate. Please understand that TravelMechanic is not responsible for these types of component failures. In the event of such failures, we will provide you with a revised estimate that includes the replacement of the failed component

Replaced vehicle parts

If you wish to receive the replaced vehicle parts upon the completion of a job, please contact us at hello@TravelMechanicPro.com. In applicable cases, you may be charged the core price for the replacement part, and you will be responsible for the proper disposal of these parts in compliance with all relevant laws, regulations, and rules. However, please note that any defective parts removed from your vehicle as part of a claim under our Limited Warranty must be returned to us

Communications

At TravelMechanic, we believe in transparent and effective communication with our valued users. By using our services, you agree to receive communications from us, which may include emails, text messages, calls, and push notifications. These communications could cover various topics, including but not limited to:

  • Operational communications: Updates regarding your Account, the use of our platform, or important information about our services
  • Service updates: Stay informed about new and existing features on our platform
  • Promotions: Discover exciting offers and promotions related to our services

You can opt out of receiving text messages (SMS) from us at any time by simply texting "STOP" from the mobile device receiving the messages. Please note that opting out of text messages may impact your use of our services. To ensure your privacy, we use a service provider to mask your telephone number when you call or exchange text messages with a technician. During this process, we collect and store data, including the date and time of the call or text message, phone numbers, and message content. We use and disclose this data for legitimate business purposes

You may also receive confirmation and other transactional emails regarding our services. Occasionally, we might send you emails or text messages about services or promotions that we think would interest you. You have the option to unsubscribe from these promotional emails at any time by clicking the "unsubscribe" link in our email communications or by contacting us directly

Promotional codes or credits

We occasionally offer promotional codes or credits, referred to as "Promo Codes," that can be redeemed for Account credit or other features and benefits related to our services or a technician's services. To ensure fair use, please adhere to the following guidelines:

  • Intended use: Promo Codes must be used by the intended audience and for their intended purpose, in a lawful manner
  • Non-transferable: Promo Codes may not be duplicated, sold, or transferred unless expressly permitted by us
  • Disabling: We reserve the right to disable Promo Codes at any time without liability to TravelMechanic
  • Specific terms: Promo Codes must be used according to the specific terms we establish for each code
  • No cash value: Promo Codes are not valid for cash and may expire before use

We retain the right to interpret how Promo Codes are used and to withhold or deduct credits or benefits obtained through the use of Promo Codes if we determine or believe that the use or redemption of the code was in error, fraudulent, illegal, or in violation of the applicable Promo Code terms or our Terms of Service

User content

We value your feedback and may, from time to time, allow you to submit textual, audio, and visual content and information, known as "User Content." While User Content remains your property, by providing it to us, you grant us a worldwide, perpetual, irrevocable, transferable, non-exclusive, royalty-free license to use, modify, reproduce, display, and distribute such User Content. This license allows us to make the most of your feedback, develop our services, and provide you with an enhanced experience

You represent and warrant that you own the User Content or have the necessary rights, licenses, consents, and releases to grant us the license described above. User Content should not infringe upon third-party rights, be offensive, or violate applicable laws or regulations. We reserve the right to review, monitor, or remove User Content at our sole discretion, without notice, for any reason

Network access and devices

To use our services, you are responsible for obtaining compatible hardware or devices and ensuring data network access. Please be aware that the Internet and electronic communications can have inherent malfunctions and delays. We are not liable for any such malfunctions or delays

Payment terms

At TravelMechanic, we aim to provide a seamless and convenient payment process for the services you receive through our platform. Please take a moment to review our Payment Terms:

Charges

When you use our services to receive Vehicle Services from a Technician, you acknowledge that Charges may apply. These Charges may encompass the cost of the services provided, including any applicable federal, state, and local taxes. To ensure a smooth payment experience, we will record your preferred payment method information at the time you schedule a job. By doing so, you authorize us to charge the relevant amount, including any additional fees, to your preferred payment method

Late cancellation and rescheduling

We understand that plans may change. If you need to cancel a scheduled job, please be aware that a Late Cancellation Fee may apply. Additionally, if you choose to reschedule a job, a rescheduling fee may be incurred. It's important to note that you should not make any alternative payment arrangements with the Technician who performs the job. We are committed to safeguarding your payment information, but we disclaim liability for any damages resulting from the release of information to third parties

Payment facilitation

Once you've received Vehicle Services through our platform, we will facilitate the payment process on your behalf. In this capacity, we act as the Technician's limited payment collection agent. Any payments made in this manner are considered equivalent to direct payments by you to the Technician. Charges are typically final and non-refundable, except when determined otherwise by us

Immediate payment

All Charges are due immediately upon completion of the services. In the event that your primary payment method is found to be expired, invalid, or otherwise unable to be charged, we reserve the right, as the Technician's limited payment collection agent, to use a secondary payment method from your Account if one is available

Charges revisions

We retain the right to establish, modify, or remove Charges for any or all Vehicle Services at our sole discretion. Should a Technician need to change or add services beyond what was initially specified in your job request, you authorize the payment of updated or modified Charges. If the Technician determines that your vehicle requires additional services or is unable to perform the requested work, a separate diagnosis fee may be applied

We are committed to transparency and strive to provide you with a clear understanding of our payment processes. If you have any questions or concerns regarding our Payment Terms, please do not hesitate to contact our support team for assistance

Please ensure that you adapt this content to your specific business practices, payment methods, and policies. Additionally, verify that it complies with any legal requirements in your jurisdiction and aligns with your company's values

Termination

Termination by TravelMechanic

At TravelMechanic, we aim to maintain a safe and respectful environment for all users of our platform. However, there may be circumstances where termination becomes necessary. We reserve the right to terminate this Agreement, your access to our Services, or suspend your Account at our discretion, with or without notice, and for any reason or for no reason at all

In the event of such termination or suspension, you are expressly prohibited from attempting to re-register or create a new account using your name, a fictitious identity, or the identity of any third party, regardless of your intent. We also reserve the right to take any legal action deemed necessary. When your Account is terminated, we may delete the Account and any associated information. Please note that you do not have ownership rights to your Account

Termination by You

You have the option to terminate this Agreement by ceasing all use of our Services entirely. This termination is effective immediately unless there are outstanding Services ordered under your Account. If any Services remain pending or in progress under your Account, this Agreement will continue until such Services have been completed or otherwise canceled in accordance with the terms outlined in this Agreement

We value your understanding and cooperation in upholding the integrity of our platform. If you have any questions or require further clarification regarding our termination policy, please do not hesitate to contact our support team

Inspection or diagnosis work

At TravelMechanic, it's important to clarify our approach to inspections and diagnoses. Please note the following:

Inspections not equivalent to state or SMOG inspections

We want to make it clear that the inspections provided through the TravelMechanic Platform are not equivalent to state inspections or SMOG inspections. Undergoing an inspection via our platform does not guarantee that your vehicle will pass a state or SMOG inspection

Diagnosis process

When you schedule a diagnosis Job with one of our Technicians, their primary objective is to identify and diagnose the issue your vehicle is experiencing. The diagnosis process may involve a systematic examination, visual inspection, and relevant tests to confirm or rule out potential part failures. While our Technicians rely on their expertise, it's essential to understand that not all issues can be pinpointed during the initial inspection

Complex problems and solutions

Some automotive problems are complex and may require a process of elimination to determine the root cause. This means that, in certain cases, a Technician might recommend replacing a suspected defective part to assess whether the issue persists. For instance, if your vehicle has an oil leak, it could originate from multiple sources within the engine. The Technician might initially suggest replacing the part responsible for the most obvious source of the leak. If additional leaks are discovered during this process, addressing those issues would involve separate work, which may result in additional charges

Limited warranty coverage

It's crucial to note that our Limited Warranty applies exclusively to repair work resulting from the diagnosis and is not applicable to the comprehensiveness of the diagnosis itself or to any issues beyond the scope of the replaced part. For instance, if a replaced part is under warranty and develops an issue, it will be covered. However, if new issues emerge unrelated to the replaced part, they may require additional services and incur separate charges

Job scheduling without diagnosis

If you schedule a Job for a specific repair without including a diagnosis, please be aware that we reserve the right to charge one hour of labor if our Technicians, upon arrival, determine that the requested Job is either not feasible in a mobile setting or if the issue necessitates a different Job that you decline. To ensure a more accurate assessment of your vehicle's needs, we strongly recommend scheduling a diagnosis when you're uncertain about the required services or repairs

We appreciate your understanding of our approach to inspections and diagnoses. If you have any questions or require further clarification regarding our policies, please do not hesitate to reach out to our dedicated support team. Pre-purchase inspection

Our Pre-purchase inspections provide valuable insights based on the visual observations and professional judgment of our Technicians. It's important to understand the scope and limitations of these inspections

Inspection conditions

The accuracy of a pre-purchase inspection can be influenced by various factors, including weather conditions, lighting, and the overall cleanliness of the vehicle, both inside and out. These factors can impact the ability to detect issues like prior repainting or bodywork. To ensure the most accurate inspection report, the vehicle should be clean, dry, and well-lit at the time of inspection. Please note that our Technicians do not clean or disassemble vehicles as part of the pre-purchase inspection process

On-site inspection

Our Technicians come to your location to conduct the inspection. They do not place the vehicle on a lift but may use floor jacks to access certain areas. Pre-purchase inspections are distinct from diagnostic Jobs, and diagnostic equipment is typically not utilized during these inspections. While Technicians may identify the Vehicle Identification Number (VIN), they do not verify the authenticity of the VIN, its history, or title

Subjective nature

It's important to recognize that pre-purchase inspections involve subjective judgments. The Technician provides their professional opinion based on their experience. If you were to perform the inspection yourself with a similar level of expertise, your conclusions might differ. Our inspections align with what you would observe and assess if you were conducting the inspection independently

Limited scope

Each inspection is limited to the specific items explicitly mentioned in the inspection report. If you request an inspection of an item not included in the report, the Technician may make a reasonable effort to inspect it, but there is no guarantee of its inclusion in the report. If the additional item is not mentioned in the report, it should be assumed that it was not inspected

Test drives

While Technicians may conduct test drives when conditions permit, a test drive is not a mandatory component of a pre-purchase inspection report. Unless the report explicitly states that a test drive was performed, no such test drive took place

No guarantees or warranties

It's important to note that pre-purchase inspection reports are not guaranteed or warranted. Changes in the vehicle's condition may occur between the time of inspection and the time of purchase, and certain components, such as those inside the engine or transmission, are not visible without disassembly. Consequently, impending issues may not be evident during the inspection

Not vehicle valuation or authentication

Neither we nor our Technicians provide vehicle valuation or authentication services. We do not determine whether a vehicle is emission compliant or its overall performance. Regardless of any comments made by a Technician, your decision to purchase or decline a vehicle remains your responsibility. Our inspections do not create any warranty for the vehicle, and your recourse for any defects is limited to any warranty offered by the seller

Not a warranty or insurance:

Please understand that a pre-purchase inspection does not serve as a warranty or insurance policy for the vehicle. If you choose to purchase a vehicle inspected by us, you are solely responsible for all repair and maintenance costs, whether or not covered by other insurance policies or warranties. Assessing the vehicle's warranty status and insurance coverage is your responsibility
